英汉法律词典中的法律术语翻译研究

内容摘要

法律术语翻译在双语专科词典中是个不容忽视的重点。本文试图讨论在双语法律专科词典中，法律术语的翻译问题和该类词典编纂的中存在的一些问题。本文首先分析了各种在法律专科词汇翻译中常用的翻译对等词和翻译方法。并选用《英汉法律词典》(2000)中D项下的175个词语作为案例分析，分析该部分词汇的对等词翻译和翻译方法。研究表明：法律术语的翻译主要以意义对等为主，翻译方法主要是直译和解释性翻译等。但是法律术语翻译仍然存在一些问题，而英汉法律词典的编纂还存在一些问题。翻译中出现的问题主要原因是对两种文化背景和两种法律体系的不理解所造成的错译和误译。在词典中还欠缺一些可以帮助使用者的一些信息，可以增加一些解释性的附注或者区分不同对等词的说明，在编排词典的宏观结构时，可以考虑到两种法律体系的不同。本文的研究结果可以为以后的双语专科词典的编撰提供一些帮助，为法律术语的翻译提供一些参考。
