中国法庭话语中的模糊现象研究

内容摘要

本文以格莱斯的“合作原则”和廖美珍教授提出的“目的原则”为理论框架，借助作者转写的两场真实的法庭审判录音语料，对中国法庭话语中的模糊现象进行了分析，旨在探讨中国法庭话语中的目的与模糊现象的关系以及模糊语言的功能。论文采用描写与解释的方法，首先详细地分析了语料中实现和理解模糊现象的种种不同的方式，并以此为基础，分析了模糊现象所体现的人际意义。最后，着重分析了模糊语言所具有的功能。研究表明，与合作原则相比，目的原则能更好地解释法庭中所出现的模糊现象。目的限制并且最终决定着模糊现象的实现与理解方式。有目的的模糊语言表明法庭参与者之间存在着不平等。我们希望，对中国法庭中模糊现象的研究，能够丰富现有的对模糊语言的研究，并且对中国法庭审判提供参考性的意见。
