The focus of this research is in the area of Intellectual Property Rights (IPR) protection which has been a continuing concern by most member countries of WTO. The central issue is whether to adopt a strong or weak IPRs protection. Developed countries tend to use various types of pressure to induce developing countries to enforce IPRs law strictly. On the other hand, the Trade-Related Aspects of Intellectual Property Rights (TRIPS) appears to require a minimum standard for IPRs protection by its desire for IPRs to contribute to the promotion of technology transfer. Developed and developing countries, and particularly, those with a growing technological capacity, expect foreign technology transfer to increase when strengthening their intellectual property protection (IPR) rights. However, some developed and developing countries are reluctant to follow the requirement of TRIPS because of their perception that IPRs protection has scarcely brought those benefits or that they suffer from it. These concerns serve as the rationale for the general purpose of this study, which is to investigate the stronger impact of IPRs protection on technology transfer and R&D spillover in developed and developing countries. The objectives of this study are:first, to investigate the impact of IPR protection on technology transfer in both selected developed and developing countries; second, to investigate the role of R&D spillover in transferring technology.The study uses panel data from30countries during2000-2011with fixed effect and random effect models. The level of technology transfer is measured by the impact of IPRs protection variable on the productivity growth of a country. This study uses the IPR protection survey variable representing the degree of IPR protection in each country which is categorized by the specific characteristics of countries. Secondly, to measure the spillover effect on technology transfer I constructed foreign R&D spillover variable using imports as weights and employed the endogenous growth framework to estimate productivity with respect to foreign R&D spillovers for the sample, the data for the research was obtained from relevant international agencies and organizations. The findings from this research provide evidence that R&D expenditure (spillover effect) plays a key role in technology transfer; IPR protection also has an impact on technological progress, and strong IPR protection increases technology transfer. This dissertation recommends that strong IPR protection would be the option for both developing and developed countries.
